Please note: Magic Villas Ltd acts purely as booking agent for SMART HOLIDAYS, the contract exists between the client and SMART HOLIDAYS, and not with Magic Villas Ltd. SMART HOLIDAYS-Booking Conditions 1.BOOKING
& CONTRACT: A provisional booking can be held on accommodation,
for 3-5 days. Within this time you should complete, sign, and return
the booking form along with the appropriate deposit to our agent, MAGIC
VILLAS Ltd . Upon receipt and subject to availability, a Confirmation
Invoice will be issued by MAGIC VILLAS on behalf of SMART HOLIDAYS,
at which point a contract in respect of all arrangements will exist
between you and SMART HOLIDAYS.
2.PAYMENT: A deposit of 25% of the total cost of accommodation, car hire or transfers, is required to be paid by cheque, credit car cheque, bank draft or bank transfer to MAGIC VILLAS. The remaining balance must be received by MAGIC VILLAS no less than 8 weeks prior to departure. If the balance is not received by this date, we reserve the right to cancel the booking and to issue cancellation charges as shown below. When a booking is made and confirmed within 8 weeks of departure, full payment is due at time of booking.
3.ACCOMMODATION: Accommodation is only for those named at the time of booking and if you wish to add members to your party, you must advise in writing, with any payment due. Accommodation is available to you, earliest between 1pm and 5pm on day of arrival, and up to 10am on day of departure. Accommodation costs include, linen, towels, and cleaning prior to arrival. Any damage or breakage must be notified and appropriate payment made, prior to your departure. We reserve the right to charge for breakage and damage not reported and discovered later. In the unlikely event that we are unable to provide the accommodation booked, we reserve the right to substitute an alternative of a similar standard, in a similar type of resort.
4.CANCELLATION: If you cancel, we require your cancellation to be advised in writing to MAGIC VILLAS and cancellation charges will be levied from the date they receive your written notice. Period

5.CHANGES: Should you wish to make changes to your confirmed booking we will do our best to assist you. A charge of £10 may occasionally be made to cover the additional administration costs.
6.LIABILITIES: Your booking is subject to the terms and conditions of companies or persons that supply services to SMART HOLIDAYS. All reasonable care has been taken in selecting the accommodation and compiling the website information. However, as all aspects of your booking are arranged through third parties, changes may sometimes occur. If we consider your holiday may be affected we will do our very best to inform you prior to your departure. We shall not be liable for any loss or damage arising in connection with a holiday caused by any matter outside our reasonable control. We do not accept any liability for the cancellation of your holiday as a result of force majeure, war, threat of war, riots, terrorist activity, industrial disputes, natural disasters, acts of government, closure of airports or similar events. We cannot be held liable for any failure in public utilities nor can we accept liability for any inconvenience, discomfort or annoyance you may suffer, by building works being carried out on properties over which we have no control. Our obligations and those of any suppliers involved in any travel arrangements that you book are to provide services and facilities with reasonable care and skill. Beyond these reasonable standards, we shall have no legal liability whatsoever to you for any loss, damage, personal injury or death, which you suffer arising directly or indirectly from any aspect of any holiday arrangements booked with us.
7.COMPLAINTS: In the event of a problem arising during your holiday you must immediately report this to SMART HOLIDAYS or one of their partner agencies on Crete (the details of which are given on your travel documents) so that local staff or suppliers have the opportunity to put things right. We do not accept liability for any complaint that was not initially registered, as until we are aware of a problem or complaint we cannot begin to resolve it. Having followed the above procedure while on holiday, should you wish to take the matter further, please write within 28 days after your return date to MAGIC VILLAS . We do not accept liability for claims received outside this period.
8.STANDARDS: The Greek Tourist Authorities classify hotels as shown on the website. Although we suggest a star rating, villas/private houses are not as yet classified. However, we do endeavour to ensure that they and indeed all the services we provide, comply with local regulations and safety laws. These regulations may differ or seem lower, than those you are familiar with, along with certain other Greek standards.
9.CONDITIONS: Any failure of one part of the contract does not mean a failure of the entire contract. In accepting your booking, it is understood with your signature, that you are agreeing to these Booking Conditions and take responsibility for full payment on behalf of yourself and all members of your party.
10. LAW & JURISDICTION: The contract exists between you and SMART HOLIDAYS. In the event of you wishing to issue Court Proceedings you should be aware that the terms of the Contract and these Booking Conditions are governed by Greek Law and both parties shall submit exclusively to the jurisdiction of the Greek Courts.
